The use of this Website and all orders of products offered on the Website imply the consultation and express acceptance of these General Terms of Sale. Any purchase of products on this Website from the Customer entails express acceptance of the General Terms of Sale as detailed hereinafter:

General provisions

These General Terms of Sale applies to all orders placed on the Website. The Customer acknowledges receiving information and fully accepts the General Terms of Sale upon placing an order on the Website.

The company individual entrepreneur Proskurina Elena Sergeevna may update or modify these General Terms of Sale at any time. Accordingly, the terms applicable to products orders by Customers are those applicable on the date of the order.

Order terms and conditions

To be a Customer of the Website, order shall be placed by private individuals or companies as «final buyers». The resale or distribution of products purchased thru the Website is strictly forbidden.

To place an order on the Website, the Customer warrants full legal capacity, being aged 18 or over and holder of a credit card or Paypal account.

Placed orders will be accepted within the limit of available stock.

Products availability

The products offered for sale and prices are those listed on the Website, within the limit of available stock. The Website makes every effort to accurately present and describe the products. Information given regarding each product information description is given on an indicative basis. The products are sold in compliance to Russian regulation and governed by the Laws of Russia.

Products are offered subject to availability. If a product unavailability’s is detected after the order was placed, individual entrepreneur Proskurina Elena Sergeevna will inform the Customer by e-mail or telephone as soon as possible, by offering the Customer:

– to partially cancel the order
– to totally cancel the order.

Registration terms

The creation of a personal account on the Website is necessary for order confirmation. This account is designed to store billing and shipping information regarding the placed order and following orders. Order confirmation

Data collected by individual entrepreneur Proskurina Elena Sergeevna constitute proof of all former transactions between individual entrepreneur Proskurina Elena Sergeevna and the Customer. Contractual information is offered in English or English according to the chosen language by the Customer and will be subject to confirmation by an e-mail sent at the latest when the order is delivered.

Individual entrepreneur Proskurina Elena Sergeevna may reject any order placed by a Customer with whom a dispute has arisen for a previous order, or if individual entrepreneur Proskurina Elena Sergeevna reasonably considers that the Customer has breached these General Terms of Sale or if the Customer engages in fraudulent activity, or for any other legitimate grounds.

Proof of purchase
Individual entrepreneur Proskurina Elena Sergeevna advises the Customer to keep a reliable electronic or printed copy containing information regarding the Customer’s order.

In application of article L. 134-2 of the Russian Consumer Code regarding any orders placed for an amount above one hundred twenty (120) Euros, individual entrepreneur Proskurina Elena Sergeevna shall retain a written copy of the contract between individual entrepreneur Proskurina Elena Sergeevna and the Customer, during a period of time that runs from the conclusion of the contract until the delivery date of the goods and for a period of ten years thereafter (as stated in the Decret 2005 137 of January, 16 2005). The Customer can, via the account, review former, current or recently delivered orders and manage and store personal information (postal address, telephone number, bank details).

Individual entrepreneur Proskurina Elena Sergeevna store recorded data in reasonably secured information systems. The data recorded by the Website constitutes proof of all the transactions concluded between individual entrepreneur Proskurina Elena Sergeevna and the Customer. The storage or orders or invoices is processed thru a reliable and durable medium and can be produced if proof is required.

Price

The products are invoiced on the basis of the displayed prices on the Website at the time the order is placed. Any order placed on the Website shall be paid immediately during order process before checkout.

The Customer accepts individual entrepreneur Proskurina Elena Sergeevna ‘s right to modify prices of the products offered on the Website at any time. However the products will be invoiced on the basis of the tariffs in force when the order is recorded, subject to the availability of such products.

Terms of payment

All orders are payable in Euros. To pay the order, the Customer has the choice between the following payment options :
– Credit Card, MasterCard, Visa
– Paypal account
– Gift certificate issued by the Website, exclusively destined for purchase of products offered on the Website (see below « Gift certificate »).

The availability and shipping time will be recalculated as per the date of reception of payment.

Individual entrepreneur Proskurina Elena Sergeevna holds the right to reject any orders if there is an existing dispute with the Customer, in the event of total or partial failure to pay for a previous order by the Customer, if credit/debit card payment authorization is rejected by the banking organizations or Paypal, or in the event of total or partial failure to pay. The transfer of property of the good purchased from individual entrepreneur Proskurina Elena Sergeevna by the Customer from a third party will not be taken in charge by individual entrepreneur Proskurina Elena Sergeevna . Only the original buyer can benefit from these General Terms of Sales.

Credit card or Paypal account debit occurs during the payment validation. In case of unavailability of ordered articles (see “Products availability”), the said unavailable products will either be exchange or reimbursed.

Retention of title

The products ordered shall remain the property of individual entrepreneur Proskurina Elena Sergeevna until full reception of payment by individual entrepreneur Proskurina Elena Sergeevna . On the effective date of delivery, the risks (in particular of loss, theft or damage) concerning the products delivered are transferred to the Customer.

Order preparation

The period of preparation of order is not included in the delivery time. During the order process, it is required from the Customer a choice of delivery method according to those offered by the Website. The transporters are the following:

– with EMS : $35 VAT according to delivery zones

Delivery costs are calculated according to the ordered products, chosen method of delivery and stated country of delivery. These costs are due by the Customer in addition of the price of the purchased products.

For Colissimo deliveries provided by EMS in Russia, if the recipient is unavailable during the visit of the Transporter, the package is dropped at the closest Post office from the delivery address. Unclaimed packages are returned to individual entrepreneur Proskurina Elena Sergeevna . individual entrepreneur Proskurina Elena Sergeevna cannot be held liable for overly long delivery time caused by the unavailability of the recipient or in case of absence of withdrawal during the given period.

Individual entrepreneur Proskurina Elena Sergeevna cannot be held liable for overly long delivery time due to errors or disruption imputable to the Transporters (partial or total strikes of the Transporters and/or means of transportation and/or of communication).

If the company individual entrepreneur Proskurina Elena Sergeevna is prevented from processing the order due to a Force Majeur event as defined by the Russian jurisprudence, for example but not limited to, an error imputable to the Customer, the delivery time is automatically extended in accordance to the delay of that said disruption. individual entrepreneur Proskurina Elena Sergeevna shall inform the Customer by e-mail or telephone on the disruption from its beginning to its resolution. If the disruption lasts more than four (4) weeks, both parties agree they can cancel the order, excluding any form of compensation for the Customer.

Delivery problems

Should there be any absence or delay in delivery above eight (8) workings days, the Customer must inform the Customer Service of the Website as soon as possible, either par telephone or e-mail at contact@the-sneg.com. All claims filed more than thirty (30) calendar days following the date of order validation will be rejected and individual entrepreneur Proskurina Elena Sergeevna will be released of all liability.

Upon reception of ordered products, the Customer must check that products are compliant. Returns – Exchanges – Refunds

Return Inquiries

If the aforementioned conditions are not fulfilled, individual entrepreneur Proskurina Elena Sergeevna may refuse the return of the related products and will send them back to the Customer, without any possibility of return or reimbursement. individual entrepreneur Proskurina Elena Sergeevna has full latitude to decide whether the products are in their original form upon reception by individual entrepreneur Proskurina Elena Sergeevna .

Return inquiries are carried thru the Customer’s The Sneg account on the Website (section “History and details of my orders”). During the return process, the Customer shall select the product(s) to be returned, chose whether it shall constitute an exchange or reimbursement, and specify the return motive. The inquiry is then submitted for validation by individual entrepreneur Proskurina Elena Sergeevna , who will notify its agreement to the Customer by e-mail accompanied by a return number.

Following the reception of the return number, the Customer can download the return note on the Website, thru the The Sneg account and attach it to the package returned to individual entrepreneur Proskurina Elena Sergeevna .

According to the Russian Hamon law, you can send a online withdrawal request ro our Customer service within 14 days after your purchase. You can find the request form online, on your customer account (“My merchandise returns” > “Withdrawal form”).

In case of exchange inquiry
Exchanges will only be accepted if the price of the initially ordered products matches the price of the requested products in replacement. In case of reimbursement inquiry

Shipping costs for the first delivery will be reimbursed; related shipping costs for the return to individual entrepreneur Proskurina Elena Sergeevna shall be borne by the Customer. In case of partial reimbursement, shipping costs will not be reimbursed.

Electronically credited invoice cannot be used on the Website and will not be delivered to the Customer under any circumstances by The Sneg or any authorized distributors of The Sneg. Non-compliant products

The Customer shall send a non-compliant product(s) inquiry the following day of delivery at the latest, any inquiry relating to delivery error and/or non-compliant product(s) evident or in quality regarding designated product(s) on the order form (sent by error, defective products, etc.). Any inquiries received passed this period will be rejected without further allowed complaint.

This inquiry shall be brought to individual entrepreneur Proskurina Elena Sergeevna by telephone or e-mail to contact@the-sneg.com.

Upon reception of the inquiry, individual entrepreneur Proskurina Elena Sergeevna shall provide a return number for the non-compliant product(s) communicated to the Customer. The return of a product(s) can only proceed after reception of a return number by following the steps issued in “Return inquiries” provision.

Individual entrepreneur Proskurina Elena Sergeevna will examine said product(s). If the non-compliant nature of the product(s) is confirmed, individual entrepreneur Proskurina Elena Sergeevna agrees to:
– either exchange the product(s) (standard exchange depending on availability or exchange for another article of the same price) and to reship it to the Costumer (delivery costs borne by individual entrepreneur Proskurina Elena Sergeevna )
– either reimburse the Customer.

In either case, shipping costs occurred for the return of the product(s) will be reimbursed only if the non-compliant nature of the delivered products was confirmed. Shipping costs must be justified with a receipt and cannot exceed 15 Euros.

Gift vouchers

Gift vouchers sold by individual entrepreneur Proskurina Elena Sergeevna on the Website are only usable on the Website and cannot be used at any authorized The Sneg distributor or any other site selling products under the brand NAT& NIN.

They are valid within one (1) year following the date of purchase and cannot be exchanged or reimbursed.

They can be combined with each other or with other promotional offers.

During purchase of a Gift voucher on the Website, an electronic code is generated then sent to the Customer by e-mail. The monetary value of the code matches the Gift voucher’s amount purchased by the Customer. The amounts are indicated in Euros VAT. The purchase of a Gift voucher does not entail delivery costs.

The Customer will be provided a confidential code with one-time use, allowing the Customer (or recipient of its choice, hereinafter called the “User”) to deduct the amount of the Gift voucher to the global amount of an order carried thru the Website.

The Gift voucher is sent by e-mail to the Customer upon payment reception.

SISTER & CO cannot be held liable in case of loss, theft or unreadability of the Gift voucher, nor in case of error in the e-mail address of the recipient of the Gift voucher.

Individual entrepreneur Proskurina Elena Sergeevna offers to the Customer to download a template on the Website that can be printed, on which the Customer can write the code, the amount for the Gift voucher and also a note in order to offer this Gift voucher. individual entrepreneur Proskurina Elena Sergeevna may not be held liable regarding the information written by the Customer on the template for the Gift certificate.

Use of Gift voucher

A Gift voucher can only be used upon creation of a The Sneg account the Website (see section “Order confirmation”).

During the order process, the User must enter the discount equivalent to the Gift voucher in the corresponding line on the form, during the payment step. The amount on the Gift voucher will be deducted from the total amount of order, which will automatically be recalculated.

If the amount of order is superior to the amount on the Gift voucher : the Gift voucher User shall pay the difference by credit card or Paypal account.

If the amount of order is inferior to the amount on the Gift voucher : the User loses the difference. No electronically credited invoice shall be delivered in return.

In case of loss or theft
Any inquiry relating to the loss of a Gift voucher must be submitted to the Customer Service exclusively by the Customer (being the person that purchased the Gift voucher ).

If the Gift voucher is still valid and the code has not been used, the Customer Service can resend the corresponding deduction code to the Customer.

If the Customer Service notices that the code has already been used, individual entrepreneur Proskurina Elena Sergeevna will not deliver any new Gift voucher under any circumstances. A Gift voucher that is lost, stolen or forged cannot benefit from any exchange or reimbursement. The Customer will be regarded as liable of any use of the Gift voucher. In case of forgery, attempt of deception or suspicion of illegal activities relating to an order paid by one or several Gift voucher(s), individual entrepreneur Proskurina Elena Sergeevna may close the corresponding Customer’s account(s) and/or request another method of payment. In that case, the designated Customer cannot request the account be unfrozen, neither the reimbursement of the amount corresponding to the Gift voucher(s).

After-sale service – Repairs

Nota bene
The after-sale service of individual entrepreneur Proskurina Elena Sergeevna (“SAV”) can only be solicited within the frame of orders processed thru the Website. Inquiries for repair relating to The Sneg products purchased in store or any other distributors will not be operated by the SAV.

Scope of intervention of the SAV
Products sold on the Website have a six (6) months warranty following the date of purchase.

Repair inquiries are processed within the limit of the competences of the SAV, which are:
– stitching problems
– ripped lining
– loss or break of the metallic parts (snap hooks, hooks, rivets, zips, etc.)
– defective zips.

Any repair inquiries sent after the six (6) months warranty period will be submitted for examination to the SAV and invoiced according to the necessary degree of intervention, upon agreement between both parties.

Procedure

1- The Customer contacts the SAV by e-mail at contact@the-sneg.com, providing its name and address, order number, and also the encountered problem, with photographs if needed.
2- The SAV examines the inquiry and validates this inquiry if the aforementioned conditions are met for the said article.
3- The Customer must then send the repair inquiry via its The Sneg account on the Website, by selecting the order then the said article.
4- The Customer receives an agreement notification from the SAV by e-mail and will then be able to generate the return note.
5- The Customer reship the product to the following address (including the return note) :

If the inquiry is delivered within the warranty period, the SAV will proceed, as much as possible, to the repair of the defective product, free of charge, and will reship the product within fifteen (15) working days following the reception of the said product.

Once repaired, the product is reshipped to the Customer, individual entrepreneur Proskurina Elena Sergeevna will bear delivery costs.

Specific cases

– Leather strip replacement: it is not necessary to reship the product. The SAV can reship the replacement piece directly to the Customer, by postal service.
– Snap hook / shoulder strap problem: if the occurred problem only relates to the shoulder strap, it is not necessary to reship the product. The Customer can only reship the shoulder strap to the SAV.

Intellectual property

The companies individual entrepreneur Proskurina Elena Sergeevna and The Sneg holds copyrights, trademarks and/or proprietary rights to publish elements that appear in the catalogue of the e-shop including but not limited to photographs, for which individual entrepreneur Proskurina Elena Sergeevna was granted publishing rights.

The Website, including (but not limited to) text, content, software, video, music, sound, graphics, photographs, illustrations, artwork, photographs, names, logos, trademarks, service marks and other material are the property of individual entrepreneur Proskurina Elena Sergeevna and The Sneg. Article 1641 of the Civil Code
